The necessity of filing an appeal is very common in Arizona. This is not by accident or some fluke. The court system, unfortunately, has a design flaw that practically invites procedural and judicial mistakes. Arizona Judges are very qualified and want to make the best decision to resolve a dispute. However the odds are stacked against our Judges despite their efforts
The problem is that Judges in Maricopa County are rotated every 2 years. Other States do not do this in the effort to make sure your Judge has a firm understanding of the area of law that they are adjudicating. Essentially, when you have a rotating system of Judges, it's quite often that litigants will have a Judge that had never practiced in an area of law that they are now attempting to adjudicate. So, many litigants may have someone deciding their case that has very little experience in that particular area of law.
While very good Judges try their best to know the law and how they are applied to the facts, many Judges simply don't know the nuances of a particular area of law, don't know the dynamics, or certain behavior patterns that someone only learns from dealing in an specific area of law for many years. Further making matters worse, Arizona has procedural rules for just about every area of law, whereas other States have the same rules that apply to all areas of law, better assuring the Judge is familiar with the court rules and how they are applied.
The result is disastrous for many people. By not staffing particular courtrooms with Judges that have previous extensive experience in that particular area of law, many outcomes become subject to further review and appeals. Again, these Judges are doing their best, but in an arena that is unfamiliar to them and the system is not designed to truly use a Judge's skills and talents, but rather, discard them.

Your right to appeal expires 30 days after the ruling is entered. So, if you just received a ruling that requires an appeal or review, you need to act very quickly, and not wait the entire 30 days because sometimes, in addition to your appeal, there are other motions that must be filed within a few days after an adverse ruling to secure your ability to seek appropriate review.
